SDK End User License Agreement

Please read this End User License Agreement ("Agreement") carefully before enabling the ByteConnect SDK. By enabling the ByteConnect SDK, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not enable the ByteConnect SDK.

This Agreement is between you and ByteConnect Ltd., a company registered in Israel under company number 517005765, with its registered office at Haarbaa 28, Tel Aviv 6473925, Israel ("ByteConnect," "we," "our," or "us").

This Agreement applies to the ByteConnect SDK only. It is separate from the Terms of Use that govern the ByteConnect website.

1. Definitions

Hosting Application – The application you have downloaded and installed on your device. As part of that installation, the ByteConnect SDK is included.

SDK – A software component embedded in the Hosting Application. When you enable the ByteConnect SDK, the SDK may use a portion of your device's unused network bandwidth to route web requests on behalf of ByteConnect's verified business customers. The SDK is designed to operate when your device is idle, or otherwise in a manner that does not materially impact your user experience or the performance of other applications running on your device.

Network – The ByteConnect peer network, consisting of devices whose users have enabled the SDK and through which ByteConnect routes traffic for its verified business customers.

The SDK does not display advertisements, does not perform cryptocurrency mining, and does not access your personal files, messages, photos, or browsing history.

2. Consent

The SDK is enabled only where you have been given a clear choice and have agreed to take part. Enabling the SDK is voluntary, and you may change your decision at any time as described in Section 6 (Term and Termination).

3. License Grant

Subject to your compliance with this Agreement, ByteConnect grants you a limited, non-exclusive, non-transferable, revocable license to use the SDK solely as embedded in the Hosting Application and solely for your own personal, non-commercial use. All rights not expressly granted to you are reserved by ByteConnect.

4. Restrictions

The installation and enabling of the ByteConnect SDK may only be done by individuals who are at least 16 years old and at least the legal age permitted by the applicable jurisdiction. You represent and warrant that you are of legal age, as described above.

You agree not to, and you will not permit others to, license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the SDK or make it available to any third party.

You further agree not to copy, modify, translate, reverse engineer, decompile, disassemble or attempt to derive the source code of the SDK, nor to interfere with, disrupt, or attempt to gain unauthorized access to the SDK or the Network, except to the extent such restriction is prohibited by applicable law.

5. Modifications

ByteConnect reserves the right to modify, suspend or discontinue, temporarily or permanently, the SDK or any service to which it connects, with or without notice and without liability to you.

6. Term and Termination

This Agreement shall remain in effect until terminated by you or by ByteConnect.

ByteConnect may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from ByteConnect, in the event that you fail to comply with any provision of this Agreement.

You may terminate this Agreement at any time by opting out of the Network through the Hosting Application's settings. You may also terminate this Agreement by deleting the Hosting Application and all copies of it from your mobile device, desktop, or other device. Upon termination, the SDK will stop using your device's resources.

7. Disclaimer of Warranties

THE SDK IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. BYTECONNECT DOES NOT WARRANT THAT THE SDK WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BYTECONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF, OR INABILITY TO USE, THE SDK, EVEN IF BYTECONNECT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above exclusions may not apply to you.

9. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

10. Amendments to this Agreement

ByteConnect reserves the right, at its sole discretion, to modify or replace this Agreement at any time. The date at the top of this page reflects the most recent revision.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law rules. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Tel Aviv-Jaffa, Israel.

12. Privacy Policy

By enabling the ByteConnect SDK, you also agree to our SDK Privacy Policy, which is incorporated into this Agreement by reference.
